SOFA Needs Congressional Approval

Peter Juul observes for the Wonk Room that much as President Bush really should have sought congressional approval for the Status of Forces Agreement with Iraq, President Obama really should seek congressional approval for the Status of Forces Agreement with Iraq.

    I, for one, am intensely interested to see if Obama stands pat on Bush-era assertions of expanded executive power (or even takes them and runs with them), or if he decides to make a clear statement that they were abuses, unconstitutional, and that his administration repudiates them. Of particular interest to me are war and military policy–does Obama believe that Congress must authorize uses of military force? (It doesn’t appear that any President since Eisenhower has–although with Congress falling all over itself to authorize any ill-conceived military venture a President throws at them, it’s hard to tell sometimes). Frankly, there’s little reason to believe that Obama is prepared to give anything back on executive power–precious little campaign rhetoric, even. For obvious institutional reasons, Presidents, of either party, are about the last place you want to look for this sort of reform/rebalancing. For slightly less obvious institutional reasons, Congress isn’t much better. I do hope, however, that this Congress and this President can somehow work together to restore some semblance of inter-branch cooperation, especially with regard to foreign policy.

    I think Obama should have a new SOFA established and have Congress vote on it. I’d like them to bear in mind that Iraq doesn’t belong to us, but the damage we did does.
