Change I Can Take Partial Credit For

Yesterday I opined that it would be nice for the Obama-Biden Transition team to switch its Flickr stream to a Creative Commons license. Click over today and you’ll see that it’s been done.

Obviously it’s not the biggest deal in the world, but as a small gesture I think it’s the right one to make. And it’s great to see them being responsive to this sort of concern. These issues generally aren’t on the radar of most people in politics, but they’re crucially important to our digital economy.

    Great. Now are you going to start crediting the artists and photographers whose work you so blithely appropriate for your blog?

    Whether or not Matt is obligated to credit the artists whose work he uses depends on which license they used, CC or not. (Of course he should, even if not obligated). Notice the Obama pictures require attribution, and still limit what you can do with them even with attribution.

    This is what I was talking about yesterday when I pointed out that CC license != public domain. There exist CC licenses that are regular old all rights reserved. CC merely makes it easy to get license language that matches your desires. The presence of a CC license doesn’t mean anybody can use the pic for anything. It depends on which license is used.

    Note to TP tech staff: there’s a Wordpress plugin to allow the use of Flickr CC images that automatically inserts the appropriate credit, so that the photographers don’t have to deal with their usernames being misspelt by Matt.

    IANAL, but the licensing agreement (be it CC-Attribution or good old fashioned All Rights Reserved or whatever) is only relevant if you actually need a license. If it’s fair use (and gosh-darnit, it seems like pictures for a blog should be fair use) then you can post away and gleefully ignore attributions.

    FYI, the relevant guidelines are:
    1. the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;
    2. the nature of the copyrighted work;
    3. amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
    4. the effect of the use upon the potential market for or value of the copyrighted work.

    But more importantly than any of those, it’s just common courtesy to give people credit for the work they do. It’s incredibly disrespectful to grab someone’s work off the web and stick it on one’s blog (especially since CAPAF claims (see the “Terms Of Use” link below) thatall the content here is “the property of CAPAF and its licensors or providers, and are protected by copyright, trademark, patent, and/or other proprietary rights and related laws, rules and regulations.” )

    The Obama transition photostream on Flickr that’s the subject of the post. Yesterday’s entries are under Creative Commons license, requiring only attribution. Today’s are back to “All rights reserved.”
